In 1808, Nancy Burke, the widow of James Burke, and Betsey and James Burke the only children of James Burke, decd., infants by Nancy Burke their next friend, complained against John Jones, the administrator of James Burke’s estate. That James Burke died intestate about 1801 in the County of Essex, that James had another daughter named Nancy who died intestate and an infant in 1807. The valuation and division of the slaves belonging to the estate of James Burke decd. Widows Dower: Sarah, Prince, and Tom, total £153:6:8. Lot No. 1 to Betsey: Lucy and Child George. Lot No. 2 to James: Rose and Humphrey. Lot No. 3 to [blank]: Peggy. All three lots equal, with cash, £102:4:5. Contains original signatures of Ann Burke and Elizabeth Burke. [Essex County, Virginia, Box Chancery No. 12, Item 12-I-32.]

On 26 September 1807, Ann Burke of the County of Essex and State of Virginia appointed her friend John Jones her agent and attorney in fact to rent out or lease “the land on which I now live for and during my life or for a shorter period time [sic], reserving to Nancy Burke and children that part of the plantation on which she now resides bounded by her Spring Branch and Branch with which it unites and continuing their courses from the heads of each to the road … and also to prosecute demand, settle & adjust with Laurence Muse esquire my claim or cause of action against him for a tresspass in cutting timber on said Land, as also for overflowing part of said Land by the Waters of his Mill Pond & receive payment & grated discharges for the same …” Signed Ann Burke. On 21 November 1808, a decree was issued in a case of Nancy Burke, the widow, and Betsey and James Burke the only children of James Burke decd, and infants under the age of 21 years by Nancy Burke their next friend, complainants, against John Jones, Admor. &c. of James Burke decd., defendant, in chancery. It is decreed that James Allen, Lewis Dix, John Collins and Ewen Clements gentlemen or any three of them do divide the slaves of James Burke decd., in the bill mentioned, named Lucy Green, Humphrey, Prince, Tom, Pegg, Sarah, & Rose, into three parts and allot one part thereof to the plaintiff Nancy Burke, for her distributive share as widow of the intestate to be held by her during her life only and then divide the remaining two third parts into three parts, and allot one part thereof to the plaintiff James Burke, one other part thereof to the plaintiff Betsey Burke, and then divide the remaining third part equally between the plaintiffs and if the said division cannot be otherwise made, that they sell such part of the said slaves as cannot be divided in kind on 12 months credit to the highest bidder. On 17 July 1809 (date recorded), Lewis Booker was bound as security for Hundley and Lewis Moody in three obligations payable to Nancy Burke, widow, and Betsey Burke and James Burke, children of James Burke deceased. Bonds amounting to £87-5 became due 17 April 1810. Hundley Moody and Catharine his wife indemnify Booker by parcel of land 37 acres bounded by the land of Hundley Moody which lately belonged to John Boughan and was recovered by Boughan from John Chenault, by land of Rickard Burke deceased and by land of Carter Croxton and by main road leading from Piscataway Old Mill bridge to Tappahannock and being that part of the tract with land held by John Chenault which was not recovered from his by the said John Boughan and which has since been conveyed by John Chenault (or by Stephen Chenault agent) to said Hundley Moody.
