Samuel Moore’s Will’s [sic]
Proceedings had before the Court of Common Pleas within and for the County of Miami and State of Ohio at the July Term of said Court held in the Court House in Troy on the 2d day of August 1848 Geo. B. Hold President of said Court and Moses G. Mitchell William Barbee & David H Morris associate Judges for said County
Be it remembered that heretofore to wit on the 2 day of August A D 1848 that the last will and Testament of Samuel Moore was presented to the said Court and proved by the oathes of Wilber Robbin Josia Westlake two of the subscribing witnesses thereto whos testamony was reduced to writing and it appearing to the satisfaction of the court that said Samuel Moore at the imte of executing the said will was of full age sound mind and memory and not under restraint
It was therefore ordered that the will and the proof thereof be put upon the records of this Court
I, Samuel Moore of the County of Miami and State of Ohio do make and publish this my last will and testament in manner and form folliwng that is to say
First, It is my will that my personal expenses and all just debts be fully paid.
Second I give devise and bequeath to my beloved wife Abigail Moore in lieu of her dower the plantation on which we now reside situate in the County of Miami and State of Ohio being the North East Quarter of Section Nine of Township Four in range six East containing about One Hundred and sixty acres during her natural life and all the live stock horses cattle sheep hogs &c by me now owned and kept thereon also all the household and kitchen furniture and other items not particularly named and other wise disposed of in this will during her natural life as aforesaid
And that at the death of my said wife All the property hereby devised or bequeathed to her as aforesaid or so much there of as may then remain unexpended be given to my youngest son Benona N. Moore and to his heirs and assigns forever excepting five dollars to be rased out of the above property which I give and devise to my oldest son Whitmore K. Moore and five dollars which I devise and bequeath to the heirs of my deceased daughter Fanny Pearson and five dollars to my daughter Mary Fielding and five dollars to the heirs of my deceased daughter Synthia Byeket[?] also five dollars to my daughter Mahitable B. Winslow to be paid by my son Benona M. Moore within one year after the expiration of the natural life of myself and beloved wife
Third I give and devise to my daughter Martha Polonton[?] fifty acres off of the West side of the quarter section of land herein before particularly described and to her children forever and described and bounded as follows to wit Commencing at the south west corner of the before described quarter or parcel of land thence south with the west line of said quarter to the North west corner then along the North line of said quarter fifty poles thence south parallel with the western boundry of said quarter to the south line of said quarter thence west along the said south line of said quarter to the place of beginning containing fifty acres more or less
Fourth. I give and devise to my son Benona N. Moore all the residue and remainder of the above described quarter or parcel of land and to his heirs and assigns forever
And Lastly I hereby constitute and appoint my son Benona N. Moore to be Executor for this my last will and Testament hereby revoking and annulling all former wills by me made and ratifying and confirming this and no other to be my last will and testament provided the above named executor shall live to carry in execution the requisitions of this will but if he should die or by any cause become disqualified to execute the same Then and in that case I hereby constitute and appoint Josias Westlake to be executor of this my last will
Signed published and declared by the above named Samuel Moore as and for his last will and Testament in presence of us who at his request have signed as witnesses to the same
