Benjamin Boughan is mentioned in the will of his father James Boughan. He and his brother Thomas were the two youngest sons. He received land in King and Queen County, Virginia called “ffrench mans Neck”. The will is dated 21 November 1721 and was probated 19 June 1722. [Essex County, Virginia, Will Book 3, pages 305–306.]
On 9 June 1747, Elizabeth Coghill, widow, in Consideration of the Natural & motherly affection that I have and Bear to my five Children Zachary Coghill Susannah Coghill Ezrom Coghill Priscilla Cognill and Gideon Coghill do give after my decease Three Negroes and their Increase Vizt. Bess, Mill and Izubell. Signed Elizabeth her O mark Coghill. Witnesses: Thomas Barker, Ben Boughan, Dorothy her + mark Boughan. On 13 September 1765, in the case of Benjamin Boughan, plaintiff, against Frederick Forson, defendant, by Scirefacias, “This day Came the Plt. and the Defent. altho Solemnly Called Came not and the Scirefacias being returned Executed It is Therefore Considered by the Court that Judgment be renewed for One hundred Seventy give pounds of tobacco and the Costs of this suit And that Execution thereon be awarded”. On 14 June 1771, in the case of Benjamin Boughan against Thomas Burk for Assault & Battery, Came the parties by their attorney also a Jury to witt John Broadus foreman &c who were sworn well and truly to try the matter on issue Joyned do say the plaintiff hath sustained damages by reason of the said Defendant to Ten pounds Current money and Costs. On 11 October 1796, in the case of John Hutcheson, plaintiff, against Thomas Burk and John Gatewood, defendants, upon a motion for a Judgment on a forthcoming and Delivery Bond, Came the parties by their Attornies and it appearing from the affidavit of Benjamin Boughan that the defendant Burk and Legal Notice of this motion, the court finds for the plaintiff. On 11 September 1799, in the case of Benjamin Baughan Executor [of?] Benjamin Baughan, Plaintiff, against Robert Hart & Company, Defendants, in Chancery, This cause was this day finally heard upon the Bill Answer Depositions and the arguements of Counsel on consideration whereof It is decreed and ordered that the Injunction in Chancery awarded the plaintiff to stay the Execution on the Judgment obtained by the Defendants against the plaintiff be made perputual and that the plaintiff recover of the Defendant the Costs by him in this Suit expended.
