He is mentioned in the 1765 will of his father Thomas Burk.
On 3 January 1786, a John Burke witnessed the will of Dolly Kerchevall of the Parish of South Farnham and County of Essex. [Essex County, Virginia, Will Book 14, pages 49–50.]
Will of John Burke, very sick and weak. Desires that all lands be sold and lifewise part of his personal estate. The rest of the personal estate and negroes to be divided between wife Susanna Burke and all his children Viz Richard, Ann, Edmund, Thomas, Susannah, William, Judith, and Lucy Burke. Thomas Allen executor. Signed John Burke, dated 12 February 1787. Witnesses: Thomas Gatewood, Martin Burke, Lewis his x mark Burke. Proved 20 October 1788, recorded 15 February 1790. [Presumably this is his will, based on the date and two nephews, children of his brother Rickard, serving as witnesses, and family names. There is no other evidence to link this will of a John Burke to the John Burke mentioned in the will of Thomas Burk in 1765. Essex County, Virginia, Will Book 14, pages 179–180.]
