From undated petition in loose papers from Burke vs. Chenault:
John Burke died sometime about the year 1787, leaving Richd, Ann, Edmund, Susanna, Wm, Judith & Thomas Burke his only children. Will dated 12 Feb 1787. Will proved in 1788. Susanna his widow. [Essex County, Virginia, Box Chancery No. 32, 1823, paper 32-I-33.]

On 3 January 1791, a deed was executed from Susanna Burke in her own right and as guardian to Richard, Ann, Edmund, Susanna, William and Judith Burke children and coheirs of John Burke decd late husband of Susanna to John Chenault of the parish of Southfarnham and County of Essex, administrator of the estate of John Burke. Whereas the said John Chenault as administrator with the will annexed of the said John Burke deceased obtained a decree of the worshipful Court of Essex County at a Court held for the said County on the 16th day of March 1799 against the said Susanna in her own right & as guardian to the Children above mentioned, whereby it was decreed that the said John Chenault should be appointed Commissioner to make Sale of a Tract of Land Situate, lying & being in the county of Essex near Piscataway old mill bridge whereon the said John Burke died, containing one hundred & ninety acres, more or less (and which said Tract is the Tract of land devised to the said John Burke by his father Thomas Burke) and also that the said guardian to the Children above mentioned should make a Title in fee to the purchaser of the said Tract of Land, by virtue of which said decree the said John Chenault entered into the said Tract of land & having exposed the same to Sale to the highest bidder, after duly advertizing the same, became the purchaser thereof for the sum of two hundred & Seventy pounds current mony of Virginia. On 18 September 1795, Edmund Burke of the County of Culpepper of the one part sold to John Chenault of the County of Essex of the other part. “Whereas John Chenault as admor with the will annexed of a certain John Burke decd the father of the said Edmund Burke at a Court held for essex County on the fifteenth day of March Anno Domini One Thousand Seven hundred and ninety obtained a decree of the said Court against Susanne Burke in her own right and as guardian of the said Edmund Richard, Ann, Susanna, William and Judith Burke Children of the said John Burke decd appointing the said John Chenault Commissioner for the purpose of Selling the lands mentioned in Will [sic] of the said decd and dividing the money arising therefrom amonge the aforesaid Children of the said John Burke decd According to the aforesd Children Shall Make a title in fee Simple to the purchase of the sd Tract of Land and that the said Children respectively within Six Month after each attains the Age of twenty one years shall Confirm the said title or shew good cause to the Contrary and Whereas the said Guardian Susanna Burke According to the said decree hath make a title in fee simple to the aforesaid John Chenault who became the purchaser of the said Tract of Land at publick Sale and whereas the said Edmund Burke is of the Age mentioned in the said decree and within the Terms thereof upon which he is bound to Confirm the Aforesaid Title” … Edmund Burke for £18 doth hereby grant unto John Chenault his undivided portion of land mentioned in the will of John Burke deceased.
