John Upshaw Waring was mentioned in the 24 March 1795 will of his father, Thomas Robinson Waring, proved on 21 September 1795. Lend to beloved wife my whole Estate during her life, my children to be maintained and educated by her out of the profitts of the said Estate. At her death, estate to be devided in the following manner. To son John Upshaw Waring and my son Robert William Waring the whole of the tract of land I live on to be equally devided between them. The whole of the residue of my estate to be equally devided between my two sons and my daughter, now an infant intended to be baptized by the name of Elizabeth Matilda. John Upshaw Waring was mentioned in the will of William Upshaw, dated 29 August 1811. Nephew John Upshaw to take possession of all effects and property within the Territory of Orleans, and to inherit all property real and personal after the payment of just debts. Brother Edwin Upshaw of the state of Virginia to inherit all property within that state. Received by the register of wills in New Orleans on 16 September 1811. A petition by John Upshaw Waring states that William Upshaw died on 31 August 1811. On 17 February 1812, the will with accompanying testimonials was presented in Essex County court and was ordered recorded. [Essex County, Virginia, Will Book 17, pages 334–336.]

On 16 September 1833, John U Waring, John H Upshaw, Arthur F Rennolds and Richard L Covington were bound $1,000 for John U Waring’s administration de bonis non with the will annexed of Robert P Waring deceased. [Essex County, Virginia, Will Book 23, page 137.]
