Last will and testament of Thomas Robinson Waring. Just debts to be paid. Lend to beloved wife my whole Estate during her life, my children to be maintained and educated by her out of the profitts of the said Estate. At her death, estate to be devided in the following manner. To son John Upshaw Waring and my son Robert William Waring the whole of the tract of land I live on to be equally devided between them. The whole of the residue of my estate to be equally devided between my two sons and my daughter, now an infant intended to be baptized by the name of Elizabeth Matilda. To brother Robert Payne Waring my riding horse saddle and bridle. Loving wife executrix and my father Robert Payne Waring and my brother Robert Payne Waring and my two sons are to be executors. 24 March 1795.

On 21 September 1795, this last will and testament of Thomas Robinson Waring, otherwise Thomas R. Waring, was presented in court by Lucy the wife of the said Thomas the executrix therein named, and proved by James Evans and John Bush. Certificate granted to Lucy for her obtaining probate.

On 21 September 1795, executorship of the estate of Thomas R. Waring was granted to Lucy Waring. Lucy Waring and John Upshaw acknowledge their bond in the penalty of £3,000. [Essex County, Virginia, Will Book 15, page 154.]
Pursuant to an order of Essex County court bearing date September 1795, an inventory of the estate of Thomas R. Waring was made by John Montague, James Evans, and John Evans, and was submitted by executrix Lucy Waring and ordered recorded on 18 April 1796. [Essex County, Virginia, Will Book 15, pages 223–225.]
