In the Name of god Amen I Robert Payne Waring of the County of Essex being sick & weak of Body but of sound disposing mind & memory thanks be to god for the same & considering that it is appointed for all men once to die make & ordain this my last will & Testament in manner & form following (Vizt.) — Item I lend unto my beloved wife Sarah Waring the Plantation whereon I now live for and during her widowhood hereby meaning all the Lands now to be discrib’d Beginning at my out Gate near the main Road with Mr. Fishers Corner thence with the Road to the foard or main Hoskinsis creek & down the said creek its several courses to John Waggeners line near a marked Maple at the mouth of my old House spring branch thence up the said branch its several courses to a corner Maple thence up a Small Branch with said Wageners line to a large Spreading Red or Black Oak Corner to Wm. Meadows Decd. said Waggener & myself thence along a strait ditch the line between said Meadows’s Estate & my self to the Main County Road leading to Hobbsis Hole thence along the said Road to the fork at the Corner between said Fisher & myself thence with with [sic] a line a marked trees between this land & said Fisher to the Gate above mentioned at first Begining. & in case my said Wife should Marry again then to have & enjoy one Half of the said Tract of land during her life I also lend unto my said wife one half of the House hold & Kitchen furniture also one half of the stocks of cattle Hoggs & sheep on the said plantation for & during her life I also give until my said wife my Carriage & Harness & the Horses generally drove with it to her & her heirs forever. — Item I Bequeath unto my Son Robert Payne Waring my Tract of Land commonly called & Known by the name of Payns Island also a small Tract undivided between my Brother William Waring & myself Commonly called & Known by the name of Manarnds Swamp refeference to the deeds & Survey in my Possession it wll more fully appear which said lands I gave unto my said son by a Deed of Gift in the year of our Lord one Thousand seven hundred & Eighty nine Acknowledged & recorded in the County Court of Essex Reference to said Deed Being had it wil more fully appear & this bequest is made in this my land will to fully & amply confirm the said Deed in every respect agreeable to the full Intention & meaning thereof. — Item I give & Bequeath unto my Daughter Catharine Robinson Latane all that piece on the north side of the Road leading from my out Gate to Tappahannock as hereafter discribed & intended shortly to be laid off Begining at the main Road with a strait ditch Corner to Daniel Sullivan thence westerly along the said Road to the turn of my Ditch, thence directly to the head of a Gully in the edge of the old field & down the same a Small distance to the water & down the said water Course to where it emptyes into the main long branch between me & Mr. John Rennolds thence down the meanders of said Run to the great Roaring Run corner to said Rennolds, Thomas Barton & this land, thence down the said Roaring Run to the mouth of a branch the line between Thomas Waring & my self thence up the meanders of said Run to a poplar Stump formerly the marked Corner between this land & said Thos. Waring thence up the Hill bearing Easterly with said Warings line to said Sullivans Corner, thence across the old field with a straight ditch the line between this land and the sd. Daniel Sullivan to the Begining I also give to my said Daughter my negroes Lucy Dinah & Letty mother of Dinah also one Sorrel Mare all in her actuall possession except Letty & Several other things which are intended to be shortly delivered her in full of all claim to every part of my Estate — Item I give & Bequeath unto my two sons by my second wife the lott or moiety of land which I purchased of Ewen Clements commonly called & Known by the name of Lowryes by deed of Feeoffment Recorded in the County Court of Essex reference being had to said Deed it will more fully appear to them & their Heirs forever & in case of the death of either of them before they come of age or Marry that then it is my wil & desire that the whole of the legacies now given or hereafter to be given in this Will desend & go to the survivor & in case they shoud both depart this life before they come of age or Marry that then the whole of the Estate intended to be given them dessend & go to my Younger children except the land which I desire may be divided between my two younger sons Horrace & Francis or the survivor of them. — Item I give & Bequeath unto my son Epaphroditus Lawson Waring my Mantion Plantation lent my wife to take effect precisely as discribed in the clause lending the same to his Mother, as to her Marrying, to him & his Heirs forever but in case he shoud die before he comes of age or Marryes that then it is my will & desire that that the said Land be Equally divided between my two younger sons Horrace & Francis or the survivor of them & for them to the accountable to my three Daughters as soon as convenient to them in property or money for one Hundred pounds each — Item. I give & Bequeath unto my two sons Horrace & Francis Gardner Waring my Dragon Plantation to be equally divided Between so as for each to to [sic] have an Equal Moiety in the reclaim’d Dragon Swamp & in case either of them shou’d die before they come of age or Marry that then the survivor of them enjoy the whole of the said legacy to them & their Heirs forever & in case they shoud both die before they come of age or Marry that then the said Land & every other property given them descend & go to my two Daughters Maria & Elizabeth Gardner Waring to them & their heirs forever. — Item I give & Bequeath to my two Daughters Maria & Elizabeth Gardner Waring the Tract of Land & Mill & every thing thereto belonging purchas’d of Henry Dunn & Thomas Fauntleroy Esq. & also the ballance of the Land on the north side of the Road from Benjamin Fiskers [sic] Corner at the fork leading to my Mill thence down the main road to Mr. John Gatanges [?] Corner at the turn of the ditch & down with his line to the long branch discrib’d in his line & up the said branch its several cources between my & Mr John Rennolds to a Corner Gum or Maple back of where Mrs. Soreal [?] lives to be Equally divided between them when they shall come of age or marry & in case of the death of either of them for the other to have & enjoy the whole legacy & in case they should both die before such period that then my son Lawson meaning Epaphroditus Lawson Waring having & enjoy the said legacy to him & his Heirs forever — Item it is my will & desire that the ballance of the Negroes which came by my first wife decend & go to my son Robert Payne Waring by name Jacob at the Dragon Plantation, Manuel at the home House & Joane in the Is’land. — Item it is my will & desire that that [sic] my wife Sarah Waring have & enjoy all the Negroes that came by her during her Natural life & at her death to be equally divided between all the surviving children which I have by her or any of them or there Heirs who liv’d to be married & leaving children to them & their Heirs forever. — Item it is my will & desire that all the residue due of my Estate after my lawfull debts are paid not before given away be Equally divided amond all my Children except twelve Negroes Eight of which to be working Negroes which I lend my said wife during her life & it [sic] her Death to be equally divided among all my children nothing in the clause resp’ting my Daughter Catharine R. Latane to the Contrary. — & Lastly I appoint my Brother William Waring William Latane Esqr. my son Robert Payne Waring my son William Lowry Waring & my son Epaphroditus Lawson Waring Executors to this my last Will & Testament in Witness whereof I have hereunto set my Hand & afixed my seal this thirteenth of Octr. 1798 —

Annexed is a co dicil to this my last Will & Testament dated the 13th of Inst. 1798 — which it is my desire & meaning shall be taken as part of said will as fully as if the whole had been written on the same sheet of Paper. — Item I give & Bequeath to land Ten Negroes & every thing else formerly given to my son Thomas Robinson Waring & to his heirs forever as a full compensation of evey claim against my Estate to descend & go agreeable to the directions of the will of my said son now Decd. — Item it is my will & desire that the whole of the Estate lent to my wife & also that given to her five children to be kept’d together for the general benefit of the whole of them so long as my wife remains Single but in case she should marry that then it is my desire that every child receive their parts of the Estate agreeable to the directions of the Will in witness whereof I have hereunto set my hand & fixed my seal this 26th day of Octr. 1798.

Cordicil [sic] 2d — It is my will & desire that my beloved wife Sarah Waring have my mahogany curtain Bedstead Bed & furniture also mahogany Bureau & Glass that usually stands on it. It is also my Will & desire that my Plantation call’d in my within will the Dragon Plantation and devised in my said Will to my two youngest sons Horace and Francis Gardner Waring be now equally divided betwen my son Francis Gardner Waring & my Daughter Catharine R Latane to be divided so as for each to have an equalty Moiety in the reclaimed Dragon Swamp & it is my desire that my said daughter Catharine R Latane shall have the part of the sd. plantation whereon the houses are: the said houses not to be considered in the division of the sd. land; it is also my desire that the wood land on my son Francis Gardners part of the said plantation shall not be cut down except for fencing fire wood & timber for the use of the sd. Plantation, which said Plantation I give to my said son Francis Gardner & Catharine R. Latane to them & their Heirs forever. — and the piece of land given (& discribed as above in my sd above will) to my daughter Catharine R. Latane I give to my son Horace Waring & his heirs forever in lieu of the half of the dragon Plantation — Item I give to my two sons William Lowry and John Waring my Black walnut curtain bedstead Bed and furniture also Bureau upstairs — it is my desire that this cordical shall be taken as a part of this my last will & testament. On 17 June 1799 presented in court by William Waring jr. one of the executors therein named, who relinquished his right to the execution of the will. Proved by William Waring Junior, Anty. Gardner, and Thomas Fauntleroy, and ordered to be recorded.

On 21 October 1799, Thomas Bridges and his wife Sarah Bridges, who was the widow of Robert P. Waring, deceased, relinquished any right to administer the estate of Robert P. Waring. Signed Thomas Bridges and Sarah Bridges. Witness: Danl. Sullivan. Presented in court on 22 October 1799 and proved by Daniel Sullivan, and ordered to be recorded. [Essex County, Virginia, Will Book 15, page 502.]

On 23 October 1799, administration with the will annexed of the estate of Robert Payne Waring was granted to William Latane. William Latane and William Waring Senior acknowledge their bond in the penalty of $20,000. [Essex County, Virginia, Will Book 15, page 503.]

On 2 January 1800, an inventory and appraisal of the estate of Robert P. Waring deceased was made by James Allen, John Jones, and W. Fisher. Ordered recorded on 17 March 1812. [Essex County, Virginia, Will Book 17, pages 348–349.]

On 29 January 1800, an inventory and appraisal of the estate of Robert P. Waring deceased “being property brought from Payns Island” was made by James Allen, John Jones, and W: Fisher. Ordered recorded on 16 March 1812. [Essex County, Virginia, Will Book 17, page 350.]

On 17 March 1812, an inventory and appraisal of the estate of Robert P. Waring deceased by James Allen and Erasmus Jones was returned by Henry W. Latané, administrator with the will annexed of William Latané deceased who was administrator of the said Robert P. Waring deceased. [Essex County, Virginia, Will Book 17, pages 344–347.]

The estate of Robert P. Waring, deceased, in account with Archibald Ritchie, Sheriff & Committee, for 1817 was settled on 5 March 1818 by Laurence Muse, Benjamin Blake, and W. B. Matthews. [Essex County, Virginia, Will Book 18, pages 475–476.]

On 16 September 1833, John U Waring, John H Upshaw, Arthur F Rennolds and Richard L Covington were bound $1,000 for John U Waring’s administration de bonis non with the will annexed of Robert P Waring deceased. [Essex County, Virginia, Will Book 23, page 137.]
