Robert was mentioned in the 13 October 1798 will of his father, Robert Payne Waring, proved on 17 June 1799. [Essex County, Virginia, Will Book 15, pages 457–461.]

On 20 July 1802, Robert Payne Waring and Lawrence Muse entered into a bond in the penalty of $5,000 for Robert P. Waring’s administration of the goods, chattels and credits of John Latane, deceased. [Essex County, Virginia, Will Book 16, page 153.]

The will of Robert P. Waring of the County of Essex was dated 11 January 1844. After payment of debts, estate to be divided into two parts. One part of daughter Lucy Baylor. The other part to daughter in law Eliza S. Waring and her four children Robert Payne, William Lawson, Lucy Robb, and Thomas Robinson Waring. Son-in-law Richard Baylor and grandsons Robert Payne and William Lawson Waring to be executors. Signed Rob: P Waring. Witnesses: Jno: P. McGuire, Benj R. Baird, James R. Dishman. On 10 February 1844, proved by all three witnesses. Certificate granted to Robert Baylor in order to his obtaining probate, entered into a bond in the penalty of one million dollars.
