The will of James Davis was dated 21 January 1810. Beloved wife Lucy. My three children Zachariah, Walker and Eliza Davis. Son Carter Davis. Sons William Davis, Lindsay Davis, Thomas Davis, under 21 years of age. Carter Davis and Wiliam Davis to be executors. No signature recorded in the will book, but witnessed by Abraham his x mark Williamson, John his x mark Bush. Proved on 20 March 1810. Widow Lucy Davis renounced benefit of the will, certificate of probate granted to Carter Davis. [Essex County, Virginia, Will Book 17, pages 153–154.]
On 20 March 1810, Carter Davis and Robert Gordon were bound in the penalty of $1,000 for Carter Davis’s execution of the last will and testament of James Davis. [Essex County, Virginia, Will Book 17, pages 154–155.]
On 3 April 1810, sales of the estate of James Davis were made, and on 16 November 1812 were ordered to be recorded. [Essex County, Virginia, Will Book 17, pages 429–432.]
The estate of James Davis, deceased, in account with Carter Davis, executor, from 1810 to 1811 was settled on 28 November 1811 by Jno. Dunn, Jno. Smith, and Francis Smith. Seven legatees: William, Carter, Lindsay, Thomas, Zachariah, Walker, and Elizabeth Davis. “The legacy and residing estate devised by the will of the testator to his son Thomas, divided as follows to wit, to William, Carter and Lindsay Davis whole brothers £9.3.9 each and to Zachariah, Walker and Elizabeth Davis half brothers and sister £4.11.10-1/2 each … the said Thomas having died before he attained legal age” [Essex County, Virginia, Will Book 17, pages 432–434.]
