Mourning was mentioned in the 10 November 1808 will of his father, James Johnston, proved 17 December 1810. [Essex County, Virginia, Will Book 17, pages 253–254.]
On 18 March 1811, Mourning Johnston and Ephraim Beazley were bound in the penalty of £2,000 for Mourning Johnston’s administration of the goods, chattels and credits of James Johnston, deceased. [Essex County, Virginia, Will Book 17, page 272.]
On 16 October 1815, Mourning Johnston and William Coleman were bound in the penalty of $800 for Mourning Johnston’s administration of the goods, chattels and credits of Brooking Johnston, deceased. (The name originally written Johnson, but Mourning signed Johnston.) [Essex County, Virginia, Will Book 18, pages 219–220.]
Mourning Johnston was mentioned in the undated will of his brother, Pitman Johnston, and was to receive the entire estate. Proved 17 July 1826. [Essex County, Virginia, Will Book 20, pages 415–416.]
On 17 July 1826, Mourning Johnston and Green Coleman were bound in the penalty of $600 for Mourning Johnston’s administration of the estate of Pitman Johnston. [Essex County, Virginia, Will Book 20, page 416.]
On 16 November 1829, Mourning Johnson and William Fisher were bound in the penalty of $4,000. Whereas in court held 16 November 1829 it was found by sundry witnesses that Delila Ferrell is an idiot, or lunatic and incapable of taking care of her person and property, the court did appoint Mourning Johnson Committee as well as of the person of Delila Ferrell.
