Robert Munday was mentioned in the 5 September 1835 will of his father, Francis Munday, proved on 19 October 1835. [Essex County, Virginia, Will Book 23, page 415–417.]
On 19 October 1835, James Munday, Robert Rowzee, Larkin Noel, Lowry Elliott, and Robert Munday were bound in the penalty of $14,000 for James Munday’s execution of the will of Francis Munday, deceased. [Essex County, Virginia, Will Book 23, page 417.]
In 1839 (date and month blank), Robert Munday, Sally Munday, Elizabeth Stokes and James Burke were bound, that is the said Robert Munday and Sally Munday to the said Elizabeth Stokes and James Burke in the sum of five hundred Dollars, and the said Elizabeth Stokes and James Burke to the said Robert Munday and Sally Munday in the like sum of five hundred Dollars. The condition of this obligation is such that whereas William Younger in his last Will bearing date the first day of May 1837 and of Record in the County Court of Essex give to his daughter Sally Munday the Wife of the above bound Robert Munday one half of his Land, and to Elizabeth Stokes Wife of Benjamin Stokes in Trust with the above bound James Burke dureing her life the other half of his land, and the said Robert Munday, Sally Munday, Elizabeth Stokes and James Burke Trustee as aforesaid, in order to have an equal division thereof have mutually chosen Benjamin H Munday and Edward Powers to divide said land agreeable to quantity and quality and allot to each one their portion. If all parties stand to abide by the division, then this obligation to be void. Signed Robert Munday, Sarah her x mark Munday, Elizabeth her x mark Stokes, James Burke. The estate of William Younger, deceased, in account with James Burke, executor, from 1839 to 1840 was ordered recorded on 17 August 1840. Includes distributions to Susan, Waller, William, David and Mary Elliott; James Burke as trustee for Elizabeth Stokes; James Burke and Susan his wife who was Susan Younger; and Robert Munday and Sally his wife who was Sally Younger. We the undersigned Legatees of Francis Munday decd. do hereby acknowledge that we and each of us have received of James Munday Executor of the said Francis Munday decd. the full amount to which we and each of us are entitled to of the balance reported to be due from the said James Munday Exor: as aforesaid pr his account of records in the Clerks Office of Essex County Court; We do also acknowledge that we have received the amts due to us respectively from the nett proceeds of sales of the negroes of said F. On 13 September 1843, This day Reuben Munday personally appeared before me a Justice of the peace for said County and made oath that he was present at the settlement which took place between Alexander Baker who intermarried with Kitty Munday and James Munday Exor of Francis Munday decd the said Baker being in right of his wife entitled to a portion of the Estate of said Francis Munday decd and saw the said James Munday Exec: as aforesaid pay said Baker the sum of Three hundred and Twelve Dollars and sixty five cents the proportion of the net amt: of proceeds of sale of the negroes sold under a decree of the County Court of Essex made in the Chncy: suit of Mundays vs Mundays Exor: in the year 1835 — this settlement took place as well as he recollects in the year 1840 and at the same — a settlement took place and said James Munday paid said Baker the proportion to which he was entitled of the balance report to be due pr. the said James Mundays admon: acct: of record in the Clerks Office … signed Richard Rouzee
Lucy Munday this day personally appeared before me a Justice of the Peace in and for the County aforesaid and made oath that she was present at a settlement which took place between Molly Munday now deceased and her Brother James Munday Exor: of Francis Munday decd. and saw the said James Munday exor: as aforesaid pay the sd. Molly Munday the sum of Three hundred and twleve Dollars and sixy five cents the proportion of the net amount of proceeds of sale of the negroes sold under a decree of the County Court of Essex made in The Chancery suit of Mundays vs Mundays exor: in the year 1835. This settlement took place in 1840, and at the same time a settlement took place and the said James Munday paid the said Molly Munday the proportion to which she was entitled …
