Lucy Montague was mentioned in the 8 February 1810 will of her grandfather, John Montague, proved on 21 May 1810. “… Lucy Chatherin & Amelia my Grand Daughters, who were Childrend of my deceased daughter Elizabeth, late the wife of Samuel Montague …” [Essex County, Virginia, Will Book 17, pages 169–171.]
On 21 June 1811, a deed was executed between James Montague and Elizabeth his wife of the first part; Joseph Janey, administrator of Samuel Montague, deceased, of the second part; and Lucy Elizabeth Montague, Catharine Yates Montague, and Amelia Standard Montague of the third part. Whereas William Jones by his last will and testament did devise after the decease of his mother, Mrs. Elizabeth Jones, the tract whereon his mother lived, a part to Samuel Montague, and a further 600 acres to John F. Montague, a brother to the said Samuel and James. And the said John F. Montague having died in the lifetime of Mrs. Elizabeth Montague, his part of the said land descended to his brothers William Montague and the aforesaid Samuel and James, subject to the life interest of the said Elizabeth Jones. Elizabeth Jones died, and the said Samuel became possessed of the entire tract of land, and it was never divided. Samuel and James entered into an agreement whereby Samuel agreed to pay James £400 for his part or proportion of the land. The said Samuel died intestate, not having paid the money before his death, and the land descended to the said Lucy Elizabeth Montague, Catharine Yates Montague, and Amelia Standard Montague as the coheirs and children of Samuel. The said James has demanded payment out of the estate of Samuel from Joseph Janey, administrator, and offered to execute a proper deed. Joseph Janey has paid out of the estate the remaining £272.13.3-1/4 (Samuel Montague in his lifetime having paid the remainder of the £400). Now in addition to $1 paid by the said Lucy Elizabeth Montague, Catharine Yates Montague, and Amelia Standard Montague, James Montague and Elizabeth his wife do convey to the said Lucy, Catharine, and Amelia their interest in the aforesaid tract of land. Signed James Montague, Elizabeth Montague. Delivered to court by James Montague and acknowledged as his deed. Elizabeth Montague cannot conveniently travel to court and is privately examined by Thomas Evans and Francis Smith. On 15 July 1811 ordered to be recorded. On 1 November 1834, a case was before a Circuit Court of Law and Chancery for Essex County, in which Erastus T Montague and Amelia S Montague his wife, and the said Erastus T Montague admor of Wm W Garnett and George Hoskins admor of his late wife, Catharine Y Hoskins decd, the said Amelia S. and Catharine Y, together with one Lucy E. now deceased, who intermarried with the said Wm W Garnett being the only children and heirs at Law & distributees of Samuel Montague deceased, were plaintiffs, against Thomas Gresham, executor of Joseph Janey, deceased, and William Wright, admor of the estate of Lucy E Garnett, deceased, were defendents, over mismanagement and falsification. Joseph Janey had been administrator of the estate of Samuel Montague, deceased. [Essex County, Virginia, Will Book 24, pages 230–233.]
