On 31 December 1808, sales of the estate of Elizabeth Jones, deceased, were made by Samuel Montague, executor. Ordered recorded 17 June 1817. [Essex County, Virginia, Will Book 18, pages 422–424.]

Samuel Montague was mentioned in the 8 February 1810 will of his father-in-law, John Montague, proved on 21 May 1810. “… Lucy Chatherin & Amelia my Grand Daughters, who were Childrend of my deceased daughter Elizabeth, late the wife of Samuel Montague …” [Essex County, Virginia, Will Book 17, pages 169–171.]

On 18 June 1810, Joseph Janey, James Webb, Francis Smith, William Newbill and Jno. Dunn were bound in the penalty of $30,000 for Joseph Janey’s administration of the goods, chattels and credits of Samuel Montague, deceased. [Essex County, Virginia, Will Book 17, page 197.]

On 12 July 1810, an inventory of the estate of Samuel Montague, deceased, was made by Henry Quarles, Philip Mann, Kemp Gatewood, gentlemen, and Doctor Newhall. [Essex County, Virginia, Will Book 18, pages 216–218.]

On 21 June 1811, a deed was executed between James Montague and Elizabeth his wife of the first part; Joseph Janey, administrator of Samuel Montague, deceased, of the second part; and Lucy Elizabeth Montague, Catharine Yates Montague, and Amelia Standard Montague of the third part. Whereas William Jones by his last will and testament did devise after the decease of his mother, Mrs. Elizabeth Jones, the tract whereon his mother lived, a part to Samuel Montague, and a further 600 acres to John F. Montague, a brother to the said Samuel and James. And the said John F. Montague having died in the lifetime of Mrs. Elizabeth Montague, his part of the said land descended to his brothers William Montague and the aforesaid Samuel and James, subject to the life interest of the said Elizabeth Jones. Elizabeth Jones died, and the said Samuel became possessed of the entire tract of land, and it was never divided. Samuel and James entered into an agreement whereby Samuel agreed to pay James £400 for his part or proportion of the land. The said Samuel died intestate, not having paid the money before his death, and the land descended to the said Lucy Elizabeth Montague, Catharine Yates Montague, and Amelia Standard Montague as the coheirs and children of Samuel. The said James has demanded payment out of the estate of Samuel from Joseph Janey, administrator, and offered to execute a proper deed. Joseph Janey has paid out of the estate the remaining £272.13.3-1/4 (Samuel Montague in his lifetime having paid the remainder of the £400). Now in addition to $1 paid by the said Lucy Elizabeth Montague, Catharine Yates Montague, and Amelia Standard Montague, James Montague and Elizabeth his wife do convey to the said Lucy, Catharine, and Amelia their interest in the aforesaid tract of land. Signed James Montague, Elizabeth Montague. Delivered to court by James Montague and acknowledged as his deed. Elizabeth Montague cannot conveniently travel to court and is privately examined by Thomas Evans and Francis Smith. On 15 July 1811 ordered to be recorded. On 5 October 1811, accounts of the estate of Elizabeth Jones, deceased, with Samuel Montague, executor, from 1808 to 1809 were settled by Jno. Trible, Jno. Smith, and Francis Smith. “By balance due from Saml.Montague pr. contra to be divided among the six legatees to wit, Wm Montague James Montague, Matthew T Ford & Jane his wife Robert Stubblefield & Clara his wife — John F Scott and Saml. Montague — each part amounting to £77.10.100-3/4”. [Essex County, Virginia, Will Book 18, pages 419–422.]

On 12 August 1815, William Smith, Philip Mann and Anthony Haynes settled the administration of the estate of Samuel Montague in account with Joseph Janey from 1810 to 1815. [Essex County, Virginia, Will Book 18, pages 247–257.]

The estate of Samuel Montague, deceased, in account with Joseph Janey, administrator, from 1815 to 1822 was settled on 9 April 1823 by Wm Smith, Philip Mann, and Anthony Haynes. [Essex County, Virginia, Will Book 19, pages 374–375.]

The estate of Samuel Montague, deceased, in account with Joseph Janey, administrator from 1822 to 1827 was settled on 1 June 1827 by Kemp Gatewood, Wm Smith, Anthony Haynes, and Thomas Jesse Jr. [Essex County, Virginia, Will Book 21, pages 168–170.]

On 23 May 1833, Robert Wright, deputy for Warner Lewis, late sheriff and committee of the estate of Samuel Montague, deceased, reported that there was no estate whatever to be administered. [Essex County, Virginia, Will Book 23, page 106.]

On 1 November 1834, a case was before a Circuit Court of Law and Chancery for Essex County, in which Erastus T Montague and Amelia S Montague his wife, and the said Erastus T Montague admor of Wm W Garnett and George Hoskins admor of his late wife, Catharine Y Hoskins decd, the said Amelia S. and Catharine Y, together with one Lucy E. now deceased, who intermarried with the said Wm W Garnett being the only children and heirs at Law & distributees of Samuel Montague deceased, were plaintiffs, against Thomas Gresham, executor of Joseph Janey, deceased, and William Wright, admor of the estate of Lucy E Garnett, deceased, were defendents, over mismanagement and falsification.
