Mary was mentioned in the 8 February 1810 will of her husband, John Montague, proved on 21 May 1810. She was to be executrix with William Montague and James Webb executors. [Essex County, Virginia, Will Book 17, pages 169–171.]
On 29 May 1810, Mary Montague, widow of John Montague, acknowledged an inventory and appraisal of the estate of John Montague, stating that she had possession and use of the estate with permission of William Montague, administrator, subject to any demands which might come against the estate. The will of Mary Montague was dated 19 May 1815. Daughter Victoria Dobbins. Daughters Sophronia Evans and Victoria Newhall. To son Æneas. To grand daughter Hannah B. Montague. On 18 September 1815, Amos Newhall, Thomas Trice and Thomas Jessee jr were bound in the penalty of $4,000 for Amos Newhall’s administration with the last will and testament of the goods, chattels and credits of Mary Montague, deceased. [Essex County, Virginia, Will Book 18, page 209.]
