On 1 October 1806, John Montague witnessed will of Mace Clements. [Essex County, Virginia, Will Book 17, page 7.]

The will of John Montague of Essex County was dated 8 February 1810. Beloved wife Mary. Son John Ballendine. Son Aneas. Daughter Amelia. “… Lucy Chatherin & Amelia my Grand Daughters, who were Childrend of my deceased daughter Elizabeth, late the wife of Samuel Montague …” Daughter Julia Sophronia. “… as a mark of my perpetual displeasure at the conduct of my daughter Victoria in runing away with Bob Dobbyns I give and devise to her and her heirs for ever the sum of one Shilling Sterling which is all I hope she ever will receive or enjoy out of my Estate …” Wife Mary, brother William Montague and friend James Webb to be executors. Signed John Montague, no witnesses. On 21 May 1810, presented in court and handwriting proved by James Webb and Thomas Brockenbrough. [Essex County, Virginia, Will Book 17, pages 169–171.]

On 21 May 1810, William Montague, James Webb, Thomas Brockenbough and Austin Brockenbrough were bound in the penalty of $50,000 for William Montague’s administration with the will annexed of the goods, chattels and credits of John Montague, deceased. [Essex County, Virginia, page 171.]

On 28 May 1810, an inventory and appraisal of the estate of John Montague was made by A. Newhall, James Roy, Saml Foster and James Montague. [Essex County, Virginia, Will Book 17, pages 183–189.]

On 29 May 1810, Mary Montague, widow of John Montague, acknowledged an inventory and appraisal of the estate of John Montague, stating that she had possession and use of the estate with permission of William Montague, administrator, subject to any demands which might come against the estate. [Essex County, Virginia, Will Book 17, pages 206–209.]

The estate of John Montague, deceased, in account with William Montague, administrator, from 1818 to 1821 was settled on 19 May 1821 by Joseph Janey, John Saddler, and Henry Street. [Essex County, Virginia, Will Book 19, page 217.]

The estate of John Montague, deceased, in account with William Montague, administrator with the will annexed, from 1810 to 1837 was ordered recorded 21 April 1828. [Essex County, Virginia, Will Book 21, pages 236–237.]

In 1831, orators and oratrices George M. Hundley and Mary E. his wife, Henry L. Carter admor of Anthony Thornton decd, Hannah B. Montague, Edwin Hundley and Virginia F. his wife, and the said Edwin Hundley as admor of William M. Jesse deceased and John A. Jesse an infant by the said Edwin Hundley his next friend complained to the Chancery Court of Essex County. That John Montague died testate, leaving slaves to daughter Amelia. That Amelia first married one Wm Montague by whom she had your orators and one Lucy B. Montague who married Charles S. Thornton. Then William Montague died and Amelia married Thomas Jesse and they had sons John A. Jesse and Wm M. Jesse and died on about _______ 1830, and shortly thereafter Thomas Jesse died. Wm Jesse died an infant in 1831 Administration of his estate was granted to Edwin Hundley. [Essex County, Virginia, Box Chancery No. 38, item 38-E-1.]
