On 1 February 1828, H. W. Latane, administrator of the estate of James Allen, agreed to turn over administration of the estate to Erastus T. Montague, provided H. W. Latane be held harmless. On 1 November 1834, a case was before a Circuit Court of Law and Chancery for Essex County, in which Erastus T Montague and Amelia S Montague his wife, and the said Erastus T Montague admor of Wm W Garnett and George Hoskins admor of his late wife, Catharine Y Hoskins decd, the said Amelia S. and Catharine Y, together with one Lucy E. now deceased, who intermarried with the said Wm W Garnett being the only children and heirs at Law & distributees of Samuel Montague deceased, were plaintiffs, against Thomas Gresham, executor of Joseph Janey, deceased, and William Wright, admor of the estate of Lucy E Garnett, deceased, were defendents, over mismanagement and falsification.
