John Hancock Smith was mentioned in the 3 June 1828 will of his grandfather, John Dunn, proved 15 September 1828. To grandson John Hancock Smith, the land I bought of Joseph Janey and the land I bought of the heirs of Charles Howerton decd. Son in law John Smith and grandson John H Smith to be executors. Signed Jno Dunn. Witnesses: Was: H: Purkins, Wm S Croxton, Josiah Minter, James Boughan, Vincent Taylor. Proved 15 September 1828. John Smith and John H Smith the nominal executors renounce their right of executorship, whereupon the motion of Peter J Derieux a certificate was granted him in order to his obtaining letters of administration, with bond in the penalty of $20,000, securities Charles Bray, James Croxton Jr. and Thomas Pilcher. [Essex County, Virginia, Will Book 21, pages 286–288.]

On 2 January 1830, John Smith, John H. Smith and Charles C. Smith entered into a bond of $2,102 payable to Peter J. Derieux, adminsitrator with the will annexed of John Dunn deceased. Whereas Peter Derieux has delivered to John Smith, in right of his wife Polly Smith, as a legatee under the will of John Dunn, her proportion of the slaves of John Dunn — Dick, Hannah and child, Cyrus, James, Susanna, William and Fanny — and whereas claims against John Dunn may hereafter be brought against Peter J. Derieux, and if the estate should not be sufficient to pay those claims, then John Smith, John H. Smith and Charles C. Smith shall refund to Peter J. Derieux sufficient money to satisfy the claim. On 21 May 1832, John H Smith and John Smith were bound in the penalty of $1,400 for John H Smith’s administration of the estate of Martha H Smith, deceased. [Essex County, Virginia, Will Book 22, page 453.]

On 8 May 1834, an inventory and appraisal of the estate of Casey Greenwood was made by Amos Cauthorn, J. H. Smith, and Chas. C. Smith. [Essex County, Virginia, Will Book 23, page 285.]

“Essex County to wit:
“Inquisition indented taken at Jno Crows in the County aforesaid on the 2d of Febry 1835, before me Thos. Wright Sr Coroner for the County aforesaid upon the view of the body of Alexr. Houston late of said County then and there lying dead and upon the oaths of Richd. L Covington Foreman, Richd. D Dunn, Sthreshley Dunn Jno H Smith, Walter G. Covington, Leroy Taylor, Thos. Greenwood, Lowry Norris, Fontaine Wood, Robt T Shackelford, H H Cauthorn, Ach Lumpkin good & lawful men of the County aforesaid who being sworn & charged to enquire on the part of the said Commonwealth when where how and after what manner the said Alex Houston came to his death do say upon their oaths that having examined the said Houstons body are of the opinion that his death was caused from blows inflicted upon his head — by whom they were inflicted we know not — In witness whereof as well the aforesaid Coroner as the Jurors aforesaid have to this Inquisition put their seals on the day and year aforesaid and at the place aforesaid—“

John Hancock Smith was mentioned in the 27 May 1839 will of his father, John Smith, proved on 17 February 1840, and was named executor. [Essex County, Virginia, Will Book 24, pages 442–444.]

On 17 February 1840, John H. Smith, William Smith and Amos Cauthorn were bound in the penalty of $20,000 for John H. Smith’s executorship of the estate of John Smith, deceased. [Essex County, Virginia, Will Book 24, pages 444–445.]
