Elizabeth was mentioned in the 2 August 1743 will of her husband Herbert Waggoner and was named executrix. She was to be lent Herbert’s estate during her life. [Essex County, Virginia, Will Book 7, pages 36–37.]
On 20 September 1743, Elizabeth Waggener, Erasmus Withers Allen and George Coleman were bound £500 sterling for Elizabeth Waggener’s execution of the last will and testament of Harbert Waggener. [Essex County, Virginia, Will Book 7, pages 37–38.]

On 17 October 1753, the Chancery Court of Essex County ordered Thomas to pay unto an Elizabeth Wagoner 25 pounds of tobacco for attending court one day as an evidence for him at the suit of Benjamin Allen. [Essex County, Virginia, Order Book 19, page 279.]
