On 27 April 1857, a previous court order court committing Guardianship of Charles, Thomas, Edward, Beckwith and Oscar Butler infants and orphans of Beckwith Butler to James R. Courtney sheriff was rescinded. [Westmoreland County, Virginia, Order Book 1854–60, page 213.]

On 27 April 1857, James R. Courtney with Richard S. T. Beale his security in the penalty of $1,000 qualified as Guardian to Charles, Thomas, Edward, Beckwith and Oscar Butler, infant orphans of Beckwith Butler deceased. [Westmoreland County, Virginia, Order Book 1854–60, page 213.]

On 7 July 1883, a deed was executed between R. L. T Beale commissioner acting under a decree in the case of Courtney vs Butler &c of the first part and William, Edward, Beckwith and Oscar Butler children surviving of Beckwith Butler deceased of the second part. The said Beale did on 27 January 1883 auction a small tract of land formerly owned by Beckwith Butler, after his death sold for division amongst his heirs, bid in by J. R. Courtney, and resold for division amongst his surviving children, at which time and place Wm Butler for himself and his brothers, bid $500, at which price the land was taken, and does now by these presents convey unto them the said Wm Beckwith and Oscar Butler all that certain parcel on the main road on the right hand side from the cross roads to Hutt’s Mill bounded by the said road and Sutton and Courtney and others, amounting to 52 acres.
