Elizabeth was mentioned in the 19 February 1792 will of her husband Richard Banks. She was to receive the use of the whole estate for the support of her and their two children, and one third if she were to remarry. She was name executrix, with James Jones and John Richards executors. She presented the will in court of 21 July 1793, but James Jones was named executor. [Essex County, Virginia, Will Book 15, pages 11–12.]

On 22 January 1814, a division of the slaves belonging to the estate of Richard Banks, deceased, was made by Jno. Smith, Newman Brockenbrough, and W. Blake, to Elizabeth Banks, Polly Banks (also listed as Mary Banks), and Samuel Muse (who married Elizabeth Banks). On 29 January 1819, this was further acknowledged by Eliza S Banks and Wm L Waring. The estate of Richard Banks, deceased, in account with Samuel Muse from 1810 to 1819 was settled on 29 January 1819, with equal distributions to Saml. Muse, Eliza S. Banks, and Wm. L. Waring. [Essex County, Virginia, Will Book 19, pages 28–30.]

The will of Elizabeth Smith Banks was dated 22 November 1821. The Wiliam L. Waring and my daughter Mary Waring. To Samuel Muse and my daughter Elizabeth Young Muse. To my grandson Richard James Muse, who is under 21. To my grandson Robert P. Waring, who is under 21. To my granddaughter Mary Augusta Muse. My nephew John Belfield and my sons-in-law William L.
