On 2 October 1684, in a suit between Mr. William Parker, plaintiff, and James Newball, defendant, Concerning the unlawfull Detention of a horse belonging to the plt A Jury was Impanneled & Sworne … it is the opinion of the Jury … the horse doth properly belong to Wm Parker … that the said James Newball forthwth Deliver the said horse in Dispute to the sd William Parker And that the Defend. pay to ye Plant Eight hundred pounds to tob & Cask for unlawfully Destroying the said horse with all Costs of Suite als Exec. On 7 October 1691, This day Danll: Browne as Attorney & for & on the behalf of James Newball Confessed Judgmt to Mr: Mathew Nelson for five hundred sixty & two Pounds of Tob Sweet Sented Tobo in Cask: to be pd wth Cost of Suit. [(Old) Rappahannock County, Order Book 2, page 320.]

On 10 September 1695, “James Newball is Exempted from paying Levies for ye future.” [Essex County, Virginia, Order Book 1, page 256.]

In ye name of God Amen ye last day of Augt: Ano Dom 1696 I James Newball of Essex County Tailor being Sick in body but of good & perfect memory thanks be to almighty God for ye Same & calling to remembrance ye uncertainty of this transitory life & that all Flesh must yield unto death when it shall please God to call do make Constitute, ordaine & declar this my last will & Testamt: in manner & form following revokeing & adnulling by these presents all & every Testamt & testamts will & wills heretofore by me made & declared either by word or writing & this only to be taken for my last will & Testamt & none other And first I give & bequeath my Soul unto Almighty God my Saviour & redemer hopeing to receive Free pardon & remission of all my Sins & to Inherit ye Kingdom of Heaven & my body to be buried in Such decent plaise & manner as it shall please my Exers my loveing wife hereafter named to appoint, and now for ye Setling of my Temporall Estate & Such Goods, Chattells & debts as it has pleased almighty God to bestow upon me do order give & dispose ye same in manner & form following That is to say Impr I will that all those debts & duties as I owe in right & Conscience to any manner of person or persons wtsoever shall be well & truely Satisfied & paid or ordained to be paid within Convenient time after my decease by my Exer hereafter named. Item I give my plantacon & Land to my three Sons, Nathaniel, James & George to be equally divided amongst them & their heirs for ever only my Son Nathaniel to have his first choice of the equal Shares but if in case my eldest Son Nathaniel dye without heirs then his Share to descend to my other two Sons James & George equally betwixt them & their heirs for ever but if in case my two Sons Nathaniel & James dye wthout heirs of them my plantacon & Land descend unto my youngest Son George & his heirs for ever. Item I give unto my oldest Son Nathaniel one brindled Heifer being three years old wth two Slits in each ear & halfe ye midle peice taken off Item I give unto my Second Son James one brown heifer wth a Mealey Mouth marked wth a Slit on her right Ear & two Slitts on ye left wth ye Middle peice taken out being three years old or thereabts. Item I give unto my youngest Son George one brown heifer one years old or upwards marked wth my own proper mare only a Nick undr: her left Ear. Item it is my will & pleasure that my Youngest Son George be Free & at his own dispose at ye age of eighteen years if his Mother shoud die & if his Mother die before he attaine to ye age of eighteen years then his Mother to dispose of him as she shall think Convenient. Item it is my meaning in this my last will & Testamnt: yt: my three Sons abovemenconed shall hall have ye aforesaid Heifers given by me & their female Encrease, ordaining, constituting & appointing my well beloved wife Mary Newball Exex of this my last will & Testamt. In witness whereof I have hereunto Set my hand & Seale ye day & year above written. Signed James his G mark Newball. Witnesses: Thomas Haywarton, Sam: Coates. On 19 June 1699, Mary Newball and Thomas Hawarton were bound 20,000 pounds of Tobo: & Caske for Mary Newball’s executorship on the estate of James Newball, deceased. Signed Mary her M mark Newball, Thomas Hawarton. [Essex County, Virginia, Deed Book 9, page 341.]
