On 24 February 1736, Richard Street of the County of Middlesex, planter, sold to Daniel Stringer of the said County, cooper, for £34 current money, a tract of 120 acres in Middlesex County. The deed is only partially recorded. [Middlesex County, Virginia, Deed Book 4, page 11.]
On 8 April 1737, Richard Street came this day into Court and Acknowledg’d his Deed of Bargain and Sale unto Daniel Stringer together with Livery of Seizin Endors’d Thereon as also a Receipt for the Consideration Mony (Catherine the wife of the sd Richard being first privately Examined Relinquish’d her Right of Dower to the Same) And by the Court the sd Deed Receipt and Memorandum was Order’d to b recorded. On 12 May 1740, Richard Street witnessed a deed from Rice Curtis to Peter Montague junr. Signed Richd: Street. [Middlesex County, Virginia, Deeds Etc. 1687–1750, item 57.]
In the name of God Amen I Richard Street of Middlesex County being Sick and Weak of Body but of Sound Sence and disposing Memory for which thanks be Given unto Almighty God, Calling to mind the uncertainty of this Life do make and ordain this my Last Will and Testament in Manner and Form following first I commend My Soul to Almighty God that Gave it and my Body to the Earth to be Buried in a Christian like & Decent manner at the Discretion of my Executors hereafter named and as Touching such Worldly Estate which it hath pleased God to Bless me with in this Life I Give and dispose of the same as Followeth. Impr. I Give the sum of Seventy five pounds Current money to be laid out at the Discretion of my Executors in purchasing a Tract of Land which I desire may be Conveyed to my sons Henry Street and Richard Street as Tenants in Common & to their heirs, forever if Either of my said Sons should die Before any Land shall be bought then I Give the sd sum of money to be Laid out in Land for the Survivour and his heirs for Ever, But it is my Will and Desire that my Loving Wife have the Liberty to Settle on the Lands that shall be purchased as above directed and thereon to Remain during her Widowhood, or Life so that there is no Waste Comitted on the same. Item I Give unto my Daughter Eliza. Street a Negro Boy named Jamey to her and her heirs for Ever. Item I Give unto my Daughter Catharine Street my old Mares Colt and to Each of my other Children a Colt Each as my young Mare Shall bring them forth, and if she should fail to Bring so many then so many as shall be wanting I desire may be purchas’d as they may all be made Equal in that Respect Item I Give unto my Loving wife my Riding Horse and desire that her side saddle may be well repaired at the Expence of my Estate. Item I desire that the Debt of Forty Six Shilling which Thomas Overstreet owes me may be Collected and laid out in Schooling my Godson James Crouch Item I Give unto my Loving wife and my Daughter Elizabeth Twenty Shillings each to Buy them Rings; and I give to Each of my other Children Twenty Shillings to Buy them Rings when they shall Attain to the age of Eighteen Years. Item I Give unto my son Richard the sum of Eight pounds Current money that will become due at Christmas next from my Brother Henry to be laid out in Schooling my said Son and for all other Demands that I might Claim of my said Brother Henry I do hereby discharge him Item I Give unto my Daughters, Elizabeth, Catharine and Ruth Each the Sum of Five pounds Currt money when they attain to the age of Twenty one years or Marry and if Either of them should die before they Come to age or Marry then their part to go to the Survivors All the Rest of my Estate both Real & personal I Desire may be kept together and Improved for the Benefit of my Wife and Children untill Either of my Children shall Attain the age of Twenty one years or Marry, or my wife should Marry again Then my Desire is that my said Estate be Appraised and Equally divided between my said Loving wife and Five Children to them and their heirs for ever. For fear that there should be a Defect in the Conveyance which I made to Mr. Alexander Roane decd of a Tract of Land in Caroline County which I bought of Mr. John Buckner I Give and devise the said Tract of Land unto Alexr. Roane son of the sd. Alexr. decd and to his heirs Forever or with any Limitation as is Directed by his Fathers Will. I do hereby Constitute and Appoint my Loving Wife Catharine Street and my two Friends Thomas Price and James Campbell Executrix and Executors of this my Last Will and Testament In Witness Whereof I have hereunto set my hand and Fixt my seale the 9th Day of Feby 1741.
