On 17 April 1734, John Nalle of the County of Spotsilvania and parish of St. Marks leased to Thomas Burke of the County of Essex and parish of Southfarnham. For 5 Shillings current money of Virginia, a tract of land in the County of Essex and parish of Southfarnham Containing “one hundred and Sixty five acres (Warranty) one hundred & fifty acres whereof being part of a tract of Three hundred acres purchaed by Mary Nalle of Richard Kemp as by his deed bearing date 5 June 1705, and the other ten acres being that divident of Land that was given by Will to the sd John Nalle by his father Martin Nalle deceased part of a divident purchased by the sd. On 18 April 1734, John Nalle of the County of Spotsilvania and parish of St. Marks released to Thomas Burke of the County of Essex and parrish of Southfarnham. For £42 current money of Virginia, a tract of land in the parrish of Southfarnham and County of Essex “Containing one hundred Sixty five acres (Warranty) one hundred and fifty five acres whereof (being part of a tract of three hundred acres) purchased by Mary Nalle of Richard Kemp as by his deed bearing date ye fifth day of June in the year of our Lord God 1705 doth fully appear and the other ten acres being that divident of Land that was given by Will to the sd John Nalle by his ffather Martin Nalle deceas’d being part of a divident purchased by the sd Martin Nalle of James Boughan deceas’d” by virtue of one Indenture of Bargain & Sale made in the form of one year bearing date the day before the date of these presents. On 20 May 1734, John Nalle of the County of Spotsilvania and parish of St Mark was bound unto Thomas Burke of the County of Essex and parish of Southfarnham in the sum of Eighty four pounds current money of Virginia. Whereas John Nalle hath bargained and sold unto Thomas Burke a tract of land in the County of Essex and parish of Southfarnham Containing one hundred and sixty five acres one hundred & fifty five acres whereof being part of a tract of three hundred acres purchased by Richard Kempe of Middlesex County & Conveyed by the sd Kemp to Mary Nalle mother to the sd John Nalle as by the sd Richd Kemps deed dated the fifth of June in the year of our Lord one thousand seven hunded and five it doth fully appear and the other ten acres being part of a divident purchased by Martin Nalle of James Boughan decd and bequeathed by the Last will and testament of his father the sd Martin Nalle to the sd John Nalle all which sd Lands and premises are in the possession of him the sd within named Thomas Burke by Virtue of the sd above bounden John Nalle his deeds of Lease & Release bearing date the 17th and 18th of April last past doth fully appear and made between the sd above bounden John Nalle of the one part and the within named Thomas Burke of the other part … if John Nalle and Mary his wife discharge Thomas Burke from any other claims then this obligation to be void. On 21 May 1734, John Nalle, James Farguson and Samuel Farguson were bound £100 sterling for John Nalle’s guardianship of Richd. Nalle, “and shall well & truly pay or Cause to be paid unto the sd Orphan all such Estate & Estates as now is or hereafter shall come to the hands of ye sd John Nalls as soon as the sd orphan shall attain to Lawfull age”. On 21 May 1734, John Nalle, James Farguson and Samuel Farguson were bound £100 sterling for John Nalle’s guardianship of Nathan Nalle, “& shall well & truly or Cuase to be paid unto ye sd orphan all such Estate and Estates as now is or hereafter shall come to ye hands of ye sd John as soon as ye sd orphan shall attain to Lawfull age”.. I John Nalle of Brumfield parish in the County of Culpeper being Weak of body but of Sound mind and Memory do ordain this my Last Will and Testament
I Recommend my Soul to God that gave it me Trusting thru’[?] the Merits of my Dear Redeemer to be made Partaker of Everlasting and my Body to be Burried at the Direction of my Executors hereafter Named in this my Last Will
And as for my Temporal Estate I give & bequeath it in the Following Manner
To Witt
My Will and Desire is that all my Just Debts be first Paid
Item I give & Bequeath to my Beloved Son Richard Nalle the Tract of Land whereon he now lives Containing by a Survey made by James Graves two Hundred & thirty one Acres; be the same more or Less and his & his Heirs for ever, also one feather Bed
Item I give & Bequeath to my Beloved Son John Nalle the Tract of Land whereon he now lives Containing one Hundred & Eighty Seven Acres be the same more or Less as by a Survey then laid off for him by James Graves & it is bounded as Followeth, Viz. Begining at two Red Oaks & a Hickory on the Banks of the River the South Side thereof at the Upper End of a piece Low Grounds. & Runs thence East over a Steep Point of Rocks Twenty poles to a Pine & a Maple on a Small Branch Thence South 62 Degrees East, Fifty four pole to a Spanish Oak, & a Hickory on a Ridge, thence North Eighty five Degrees East Eighty pole to a Bunch of Maples & a Red Oak on Devils Run Just below my Mill thence down the Several Courses Coursses [sic] of the Run to the Begining also I give to my Grandson John Nalle Son of my Son John Nalle & Elizabeth Nalle his Mother, a Negroe Girl Named Patty to him and he Heirs for Ever.—
Item I give and bequeath to my son William Nalle Ten Shilling. Also to his son John Nalle son of my son William Nalle & Susanna his wife, one Negroe Girl Named Fanny to him and his Heirs for Ever. also to Mary Nalle Daughter to my Son William Nalle and Susanna his Wife one Negroe Girl Named Lucy to her and her Heirs for Ever If Either of my two Grand Children die without Lawful Heirs of their Body then their Part to be Equally devided amongst the Rest of my Son William Nalles Children then Living
Item I give and bequeath to my Son Francis Nalle The Tract of Land whereon I now live above my Son John Nalles Land With the Mill & other Improvements also a Negroe Woman Named Phillis & a Negroe Girl Named Sall and their Increase to him & his Heirs for Ever
Item I give and bequeath to my Son James Nalle all my Land on the North side of Hughses River above my son Richard Nalles Land, my son Francis Nalle to Keep possession of the Land where he now lives till after my wife descease then to Return to my Son James Nalle and his Heirs for Ever
Item I Lend to my daughter Agatha Hill half the Service of a Negroe Woman named Jinney During my Daughters life the other half of the said Negroes Service to my Grand son James Sims from the time of my daughters Marriage to Russel Hill, and after my Daughers Decease I give the Said Negroe Woman Jinney and her Increase to my Grandson James Sims to him and his Heirs for Ever also Ten Shillings to my Daughter Agatha Hill and her Heirs for Ever
Item I give and Bequeath to my Daughter Mary Sims Ten Shillings to her and her Heirs for Ever
Item I give and beaqueath to my Daughter Ann Burk Ten Shillings to her and her Heirs for Ever
Item I lend my Daughter Sims one Negroe Woman Named Sarah during her Natural life and after her Descease I give and bequeath the said Negroe Woman & her Increase to my said Daughters Children to be Equally Divided to them and their Heirs for Ever also Ten Shillings to my Daughter Elizabeth Sims to her heirs for Ever
Item I give and bequeath to my Daughter Gressel Parker one Negroe Woman Named Sue and her Increase to her and her Heirs for Ever
Item I give and bequeath to my Daughter Amie Morriss one Hundred Acres of Land Adjoining Unto John Dillard & Martin Nalle and Job Pophams Lands also I give and bequeath my Grandson Martin Morriss Son of William Morriss & Amie Morriss his Wife a Negroe Boy Named Harry to him and his Heirs for Ever
Item I lend unto my Loving Wife for and During her Natural life or Widowhood the Tract of Land and Plantation whereon I now live also all my Slaves not before Bequeathed and all my Stock and furniture of all Kinds also my Will and Desire is that all the Negroes and personal Estate after my Wifes Decease or Marriage be Equally devided amongst my Children Richard Nalle William Nall Francis Nalle James Nall Agatha Hill Mary Sims Gressel Parker Elizabeth Sims Ann Burke & Amie Morriss to them and their Heirs for Ever — also my Will and Desire is that If my Son Martin Nalle should appear then my Will Bearing Date 1777 to take place. Otherwise this to Remain in full force Power and Virtue
And Lastly I do Constitute and appoint my Loving Wife Mary Nalle and my Sons John Nalle & Francis Nall Executors of this my Last Will and Testament Revoking and Disannuling all others by me before made In Witness Where I have hereunto set my Hand and affixed my seal this Sixteenth Day of September 1780
